Thanks, that's as I guessed. Does this therefore mean I also have no capital gains tax liability as I am not 'gaining' anything? There is no reason (as I see it) why the property should not be transferred, as it should have been years ago, but will this have any tax implication?

I was divorced ten years ago and the family home transferred to my ex wife. She took over the mortgage and I've had nothing to do with it since. Thank you David. Not quite what I wanted to hear but at least I know where I stand. There was a debate in the House of Lords on Monday about how unfair the current system is. I can't see changes happening quickly enough to suit my own circumstances but it does seem that some of our archaic practices are now being challenged.
