Topic: How long for a consent order to be sealed?
Written By: AO - 24 days ago
Forum: UK Divorce Forum
Hi, How long does it take for a consent order to be processed? Mine was sent to the courts by solicitor on the 3rd of this month it seems to be taking a very long time. Also I have been advised by my solicitor not to go for the absolute until this is back so how much longer can I reasonably expect to wait until everything is back? Any advice appreciated.

Well I would tend to agree with my husband that I would not touch the properties which had been left to him and his siblings by his parents. I don't know what sort of remedy the courts will put in place though as you quite rightly say everything should be split 50/50 but then on the other hand normally the children are allowed to remain in the marital home with their mother. Back to the drawing

Thanks, yes that is exactly as I thought. I keep getting asked whose name the properties are in but I don't think it is of any relevance. He is currently claiming to only want half the equity in the marital home anyway, I wonder if he will stick to his word. Forgot to mention we do have two children would that change anything?

Ok a further complication is that my brother owns half of the investment properties and holiday homes and is refusing to sell, what are my options?

OK so it doesn't make any difference at all whose name is on the title deeds then? Also just to be clear he didn't buy them they were gifted by may parents, don't know if that makes any difference though.

My husband has asked me for a divorce. We own the family home jointly, I have a part share in 2 other properties which are purely investment and we both have a quarter share in a family holiday home (which has always been lived in by a family member for free). Does he get a share in all these properties or just the family home?
