New baby with new partner - child maintenance
MattSmy - 05 February, 2018 03:37PM
Hello, I will become a dad again later on in the year and have a court order to pay child maintenance to the ex. Can I reduce that amount once the new child is born or will it have to stay the same? Will it need to go to court again?

You knew about your pre-existing obligations before you fathered another child. That is how a court will look at it.

Thanks, it was always the plan to have a child with my partner but of course we couldn't foresee the future at the time when financials were discussed - seems as though the CSA/ gov website thinks there will be a difference if circumstances change.

The CSA simply looks at the number of children. You asked about varying a court order. You should also be aware that a court has power to top up a CSA assessment if it thinks the circumstances are appropriate (such as school fees needing to be paid).
