Pension question
Beerfund - 29 January, 2018 02:56PM
This may be a silly question - but if I worked for several years prior to getting married and have pensions from these previous jobs, would my wife have a claim against them in a divorce?

My simple mind would think not - as they are pre marital assets?

It depends upon many things such as the length of the marriage and your respective needs. If, say, there were no children, you had been married one year and built up your pension over 20 years you would have a point. However, if, say, you had been married for 19 years and built up a pension over 20 years then the extra year is not likely to matter a jot.

Sorry - detail would help smiling smiley

Married 8 years, three kids.
I have pensions from different employers spanning 9 years prior to the marriage, then pension for the 8 years of marriage.

If there are three children then does your wife have any meaningful income from employment or self employment? If she has a low or non existent income from such sources then the chances are that it will not matter that your pensions were built up before the marriage. Your wife's needs will probably trump that.
