Names after Divorce

Hello all,

Bit of a hypothetical and interesting one....

1. First Marriage with Kids, everybody has the same surname.
2. Divorce
3. Second marriage - mum has different surname to kids
4. Divorce
5. Can mum go back to same surname as kids? does she have to wait until divorce is final? Is it automatic or deed poll?

Yes, if she wants. It doesn't have anything to do with divorce or deed poll. In general one can be known by whatever name one wishes in the UK. It is usually just a matter of telling everyone - friends, employer, utility companies etc. In some instances such as obtaining a passport in the new name a statutory declaration will be required but those situations can be dealt with as they arise. In most cases it is just a matter of telling everyone. This applies within marriage too. A wife does not have to take her husband's surname upon marriage if she does not want to.
