how do we settle what we agree to do

what happens when me and my wife decides to settle on what each other wants financially? Lets say for example we agree to split my savings and the value of my car 50/50, but split the house as per our declaration of trust of first 37k then 80/20 in my favour, can a judge or some one then over turn this and split everything 50/50 as they think this would be fairer?

I really don't understand the whole process. Whats worse is I still love her and want things to work and she just wants out. my brain is all over the place trying to work out whats next how to try and sort things ect..

You can agree whatever you want, get it drawn up and submit it to a court for approval. So long as the terms are broadly reasonable a court will approve an agreement within its jurisdiction to approve. However, judges exercise an independent discretion. They do not act as rubber stamps. Therefore if a proposed agreement looks unfair to a judge he/she will not approve it.

Try to do a settlement between you and your wife. If you can settle everything will be okey. Good luck!
