reference date for division of marital assets
silverlining - 15 September, 2017 11:36AM
I'm getting divorced in the country where I'm residing abroad but part of the divorce falls under English law (division of marital assets). I would like to know what is the reference date used for dividing the assets? I filed for divorce in September 2016 but the divorce is still ongoing and could be another 6 months so which date is used for the division?

Thanks

Unless there is a good reason to the contrary (such as one spouse deliberately disposing of assets) the courts will take the value as at the date of making the decision rather than some date in the past.

Ok thank you - that's good to know. My ex has acquired further company shares during the divorce process so I guess that will be added to the assets too then.

Yes, such an acquisition would normally be added to the pool of assets to be taken into account.
