Husband ran up debts
Jco - 24 August, 2017 01:46PM
Hi , my husband and I have been living apart for the last 4 years with no children involved. I now wish to file for divorce but unfortunately he has now left the area and has left no forwarding address or phone number. We have a joint mortgage and both our names are on the deeds , I have discovered that some years ago he remorgaged the property in both our names to repay debts that he had run up, I suspect that he fraudently used my details to obtain this loan. Now I have the loan company chasing payment as he has cancelled the direct debit.
Am I liable for this , please advise thank you

If the charge is secured against the property you either have to pay or the creditor will seek an order for sale. If your signature was forged they may have been negligent but in order to get definitive advice about that you would need to make an appointment to see a solicitor and take copies of all relevant documents with you.
