enforcing ancillary releif form
15kacct - 28 July, 2017 02:14PM
Hi, As part of the ancillary relief form, it stated that such monies as required to close 2 accounts without incurring any further indebtedness. 15k was set aside from the sale of the FH. A letter was went to me by her solicitor asking for the balance of those accounts as of nov 2014 plus interest to date. I have supplied this info but she refuses to accept those figures and continues to contest them. One account was for a 10k loan for completion of FH regs cert. Just over 6k was used. The balance of that acct as per her solicitors request was 9.2k. I have offered a compromise of meeting half way but is refused. My question is... can I enforce the Ancillary Relief form under the terms set out in the form and as requested by her solicitor. The wording on the ancillary relief form was by instruction of the court to her barristor. Any guidance would be appreciated.
Regards B
