Purchase of new house before settlement
Rythmix - 26 April, 2017 11:58AM

I am divorced, and my ex has submitted a Form A. I am yet to receive a date from the court.

I have two children, and we have no assets to split.

I have been paying child maintenance at the CSA agreed rate ever since we split. I have also paid £150 PCM in Spousal Maintenance, despite no agreement ever being in place. I have also made ad hoc payments for school clothes etc.

Why she has submitted the Form A is beyond me. She wants more money in Spousal Maintenance a month I can only presume.

I want to purchase a new property with my new partner. All equity in the new property would come from my partner, and I would merely contribute to the mortgage. Will there be any repercussions on this? We would have the agreement drawn up as tenants in common.

Any advice gratefully received.

In general it is better to settle formally and finally the financial issues arising from one marriage before entering into other financial transactions such as buying a new property with a property. You are inviting complication if you do this.
