Nominal Spousal Maintenance
HatMan - 03 March, 2017 11:30AM
Hi

When my wife and I were divorced in 2001 she was granted nominal spousal maintenance ( which has never been acted upon in the interim ) We both subsequently remarried although her marriage was very short - lived - She has now lost her job and has mentioned to a mutual friend that she believes that despite the passage of time and the fact that the children are no longer a responsibility she feels she might be entitled to enforce some payment and intends to take legal advice.

My understanding is that any such right died when she remarried albeit that marriage did not last...am I correct ?

Many thanks

HatMan

Brilliant news - Thanks David, small victories eh! - Will make up for her acquisition of my entire vinyl record collection at the time of split ( almost ! )

Great work - thanks again.

Even if she had not remarried she would have had an uphill task to claim substantive maintenance from you bearing in mind that none has been paid for the last 16 years. It would have required quite exceptional circumstances to have justified such a claim after all this time.
